Got a question...

Postby silvergts1998 » Wed Jan 27, 2010 11:58 am

Okay I may be eating crow here. I know I posted a topic of someone shooting a dog and so on. Well recently I had a situation. I think this is a little different..but maybe the other dog who got shot with an arrow was attacking someone else's dog. Don't know.

I have a neighbor that has several dogs that bark and run on my property. He just keeps these dogs in a small pen and doesn't even walk them or play with them. There's a leash law here where I live. One of his dogs have bitten me in the ankle in the past. More of a nip than anything else but still the dog came at me in my yard. (Happened more than once). The owner tried to call it back but the dog didn't listen.

Now today with my new dog being on my property on a leash got attacked today by one of his large dogs. My dog finally barked in fear of this dog doing harm to her. This other dog was coming at my dog barking and being aggressive. It ran off when I went after it. It later came back and did the same thing a few minutes later. I got permission to put a .45 bullet in the neighbor's dog when it comes back on my property by animal control. I have no problem doing this and will, but was wondering what you all might do. Not looking to make enemies with my neighbor, but enough is enough! His dogs have been out of control. I was going to shoot it with my high powered air rifle which is a .22 but I don't want to maim it. If I am going to shoot it, I will kill it. Any alternatives? Animal control can only do so much. They said they would send a letter letting them know I will kill their dogs if they come on my property. The only catch of shooting this dog is that I have to have my gun on me at the time of attack. Otherwise as animal control says I can't run inside to get the gun. I carry a .45 with me most of the time so not a problem. I was thinking of using pepper spray (the bear can size)...do you all think that would work? If it didn't then the dog is done the next time it attacks.

i don`t think i would be going on what animal control said. they are not the judge you may be facing if you do this. i`m not saying you shouldn`t but i just don`t think i would be discussing it on a open forum if that was what i chose to do.

If it were me I would do two things:

1) Contact your local sheriff's department and make a formal written complaint about your concern of you or your family (including your pets) being attacked by your neighbor's dog. Make certain that you call them everytime you see one of the neighbor's dogs loose, whether you are outside or not.

2) Call the local conservation officer or game warden, notify them of the smae thing.

This does a couple of things. It establishes a police record of your complaints and concerns over being attacked and reduces you of being accused of malicious inetent if you were to have a run in and you shot the dog. In other words, it doesn't look like you just went out and killed the neighbor's dog for it crapping in your yard. It also makes the local officers aware of the problem so that when they patrol the area, they can keep an eye out for the dogs being loose. Calling the police, animal control and the game wardens shows that you had a genuine concern and feared for the safety of your family. If you do happen to have another run in and pepper spray or shoot the animal, then call the police immediately to report the incident. Don't try to hide anything or it will appear that you were trying to get back at the neighbor for something. Animal control can only do so much, if you have a concern for you or your family's safety, call the police.

I am not advising you to go after the dog, just stating what I would do in your situation. Chances are if the police or wardens start knocking on this guy's door, he will pay more attention to keeping his dogs on his property.
Keep the tradition alive, teach a kid how to hunt.

Good advice.

If the dog attacks me on my property it will be the end for the dog. I have called Animal Control but it doesn't seem to work that well. I will call Law Enforcement and the Conservation Officer to see if they can help handle things.

I think I will do the dog trap thing and hit my idiot neighbor in the wallet. It appears there's a fine for getting your dog back from animal control.

The advice is right on,,,i would try and take 1 more step to C Y A, try and get it on video tape. Here in Missouri, if you kill someones dog for ANY reason other than to protect livestock,,you can go to jail. Try the police and find out if you can file a formal complaint about the dogs, i have had to do that with neighbors dogs barking at all hours of the night right under my bedroom window, the dog left the same day. Now am getting close to doing it again,,same window,,,different neighbor. I just draw the ones that have barking dogs.

All of the above would likely be considered "cruelty to animals" in a court of law and subject you to stiff penalties, perhaps even jail time and certainly a criminal record that could involve loss of all your firearms and hunting privileges! Let law enforcement handle this situation. That's what we pay them to do......
